What Building Codes Apply to a Basement Remodel

Every basement finishing project in Chicagoland has to meet a specific set of building code requirements — covering structural framing, egress windows, electrical circuits, plumbing fixtures, and fire safety. These codes exist to keep your family safe, and they’re also what separates a permitted, inspected remodel from a shortcut job that can cause problems at resale.

Below is a plain-language breakdown of the code requirements our crews build to on every basement finishing project. It’s organized by category — click any item to expand the details. This guide is for general reference; your specific municipality may have local amendments, so we confirm exact requirements with your local building division before permitting your project.

Structural & Room Requirements

An accessory dwelling unit is a dwelling unit located within an existing primary dwelling unit — including an attached garage — or an addition to it, or a detached structure on the same lot or tract as the primary dwelling.

A handrail is defined by the International Residential Code (IRC) as a horizontal or sloping rail intended for grasping by the hand for guidance or support. It must be easy to grip and hold, particularly on stairs — with a graspable profile (not simply flat sides) and clearance between the rail and any adjacent wall.

A guardrail is the top part of an assembly referred to as a “guard,” located near the open sides of elevated walking surfaces to minimize the possibility of falling to a lower level, such as on a balcony or stairs. A guardrail can be built to meet graspable handrail requirements, but it’s not required to.

Habitable rooms shall have an area of not less than 70 sq. ft. and shall not be less than 7′-0″ in any horizontal dimension. Hallways shall not be less than 36″ in width, finished.

Habitable rooms, hallways, and corridors shall have a ceiling height of not less than 7′. Bathrooms, toilet rooms, and laundry rooms shall have a ceiling height of not less than 6′-8″. Beams, girders, ducts, and other obstructions shall not project to within 6′-4″ of the finished floor.

Bathrooms and toilet rooms shall be mechanically vented directly to the outdoors at a minimum rate of 50 cfm, by means of a duct with a minimum 4″ diameter. Mechanical ventilation is not required when an openable window is provided with a minimum operable opening of 1.5 sq. ft.

Basement stairs shall have a means to light the treads and landing, with a switch at both the top and bottom of the stairs on stairs with 6 risers or more.

  • Minimum head clearance from the nosing of the stair treads to the finished ceiling shall not be less than 6′-8″.
  • Maximum riser height shall be 7 3/4″ with a minimum tread depth of 10″.
  • A continuous, graspable handrail on one side of the stair is required for the full length of the flight.
  • Handrails shall be between 34″–38″ measured vertically from the sloped plane of the treads.
  • Guards are required along open-sided walking surfaces — stairs, ramps, and landings — located more than 30″ vertically above the floor below.

Enclosed space under stairs accessed by a door or access panel shall have walls, an under-stair surface, and any soffits protected on the enclosed side with a minimum of 1/2″ gypsum board.

Insulation is required to be a minimum of R-15 continuous blanket insulation or a minimum of R-19 batt insulation in all stud cavities, for the full height and length of the basement wall and crawl spaces. A vapor barrier — either the manufacturer’s kraft paper or a clear 4-mil polyethylene sheet — shall be installed on the “warm in winter” side of the wall (behind drywall), except for below-grade basement wall construction where moisture or freezing won’t damage the materials.

Basements with existing builder-provided insulation of at least R-11 for below-grade walls with continuous insulation, or R-15/19 for above-grade frame walls on a walk-out or garden level, are accepted without requiring additional insulation. Mechanical rooms without combustion air must comply with IECC Section R402.4.4.

  • Water-resistant drywall, or other approved material, shall be installed on walls in bathtub and shower spaces finished with a nonabsorbent surface.
  • Water-resistant drywall shall not be installed over a vapor retarder in a shower or tub compartment.
  • Screws shall be placed 12″ on center (nails 7″ on center).
  • Screws shall penetrate wood members a minimum of 5/8″ (nails 7/8″); screws shall penetrate steel members a minimum of 3/8″.
  • Check manufacturer recommendations for cementitious or tile backer materials — several require corrosion-resistant fasteners.

Fire & Life Safety

  • Per IRC R314.3, smoke alarms shall be installed on each floor and in each bedroom, outside the immediate vicinity of the bedrooms, and not less than 36″ from a bathroom door or opening with a tub or shower.
  • New smoke alarms shall receive primary power from building wiring (120 volts, with battery backup) and be interconnected so that when one activates, all sound.
  • Smoke alarms shall be interconnected by hardwire or radiofrequency wireless.
  • Shall not be located within 36″ of environmental air vents (supply and return) or ceiling fans, and shall follow manufacturer specifications for placement near ceiling fans.
  • When finishing a basement, or adding sleeping rooms to an existing dwelling, the entire dwelling unit must be equipped with smoke alarms as required for new dwellings.
  • Shall be listed in accordance with UL 2034. Combination carbon monoxide and smoke alarms shall be listed in accordance with UL 2034 and UL 217 (generally found in the product specification sheet).
  • Where permitted work occurs in existing dwellings with attached garages or fuel-fired appliances, carbon monoxide alarms shall be provided.
  • Carbon monoxide alarms shall be installed within the immediate vicinity of all bedrooms throughout the home, within 15′ of the doorway.
  • Where a fuel-burning appliance is located within a bedroom or its attached bathroom, a carbon monoxide alarm shall be installed within the bedroom.

Fire blocking is a “blocking” device inserted between the top plate of an exterior wall and the exterior masonry wall. Its purpose is to prevent smoke and flames from reaching the first floor from the basement by starving a potential fire of the combustible oxygen it needs to spread — typically using wood or drywall to create an air-starved cavity.

Fire blocking shall be provided to cut off all concealed draft openings and form an effective fire barrier between stories, including:

  • In concealed spaces of stud walls and partitions, including furred spaces, at the ceiling and floor level and at 10′ intervals, both horizontal and vertical.
  • At all interconnections between concealed vertical and horizontal spaces, such as soffits, drop ceilings, and cove ceilings.
  • In concealed spaces between studs adjacent to stair stringers.
  • At openings around vents, pipes, and ducts at the ceiling and floor level — batts or blankets of mineral wool, un-faced fiberglass, or spray foam may be used.
  • 2x lumber (2×4, 2×6, etc.)
  • Two thicknesses of 1x lumber (1×4, 1×6, etc.) with staggered joints
  • One thickness of 23/32″ plywood or OSB, joints backed with the same material
  • One thickness of 3/4″ particleboard, joints backed with the same material
  • 1/2″ gypsum board
  • 1/4″ cement-based millboard
  • Batts or blankets of mineral wool glass fiber, securely retained in place
  • Cellulose insulation tested in accordance with ASTM E119 or UL 263 for the specific application

Emergency Egress

Emergency egress is required for all unfinished basements, regardless of when the house was originally constructed, and in all basement bedrooms. Basements with bedrooms are only required to have egress in the bedrooms themselves. If your basement doesn’t currently have one of the egress options below, one must be provided. Cutting new openings in existing basement walls requires a stamped, structural engineered plan submission — if your basement has no egress option, we contact the building division on your behalf.

  • Escape window opening directly to the outside (walk-out basement condition)
  • Escape window opening into a window well
  • Door opening directly to the outside (walk-out basement condition)
  • Door opening to a bulkhead enclosure
  • All doors and windows used as emergency egress shall operate from the inside without keys, tools, or special knowledge.
  • Emergency egress windows shall provide a minimum clear opening of 5.7 sq. ft.
  • Minimum clear openable window height: not less than 24″.
  • Minimum clear openable window width: not less than 20″.
  • Windows shall have a sill 44″ or less above the finished floor.

When a window well is greater than 44″ deep, a permanently attached ladder or steps must be provided. Ladders shall be a minimum of 12″ wide with rungs spaced a maximum of 18″ on center. The bottom rung shall be no more than 18″ above the finished grade of the well, and the ladder must sit a minimum of 3″ from the wall or well without projecting more than 6″ into the required window well area — if it does, the well must be enlarged to compensate.

Plumbing Requirements

  • Shower compartments shall have not less than 900 square inches, a minimum of 30″ x 30″, and a minimum ceiling height of 70″ measured from the drain inlet.
  • Hinged shower doors shall open outward and be not less than 22″.
  • All glass enclosing a shower or tub shall be safety glazed.
  • Shower control valves shall be scald-resistant (per ASSE 1016 or CSA B125) with a hot water limit of 120° F.

Toilets, sinks, and showers shall have the following minimum clearances:

  • 21″ in front of sinks and toilets
  • 24″ in front of a shower stall opening
  • 15″ clearance from a toilet’s center to an adjacent fixture or wall, or 30″ measured center-to-center between adjacent fixtures

Mechanical Requirements

  • Furnaces, water heaters, and other appliances shall be accessible without removing permanent construction, with a minimum 30″ x 30″ clear floor space at the front/control side.
  • Clearances may be achieved by opening a door in front of the appliance; the door shall be a minimum of 6″ from the appliance when closed.
  • Doors to furnace rooms shall be a minimum of 24″ wide and large enough to remove the biggest appliance.
  • Additional return air is required when finishing the basement level — minimum size 100 sq. in.
  • Unfinished mechanical rooms shall have a light and a GFCI outlet.
  • Mechanical room access shall not be located in, or draw combustion air from, a sleeping room, bathroom, storage closet, or toilet room.

Mechanical rooms with fuel-burning appliances (other than direct vent) shall have two permanent openings to the outside — one within 12″ of the top and one within 12″ of the bottom of the adjoining wall — each with a minimum free area of 1 sq. in. per 2,000 btu/h for horizontal ducts, or 1 sq. in. per 4,000 btu/h for vertical ducts.

For mechanical rooms containing outside combustion air:

  • Walls and ceiling shall be insulated to at least the basement wall requirement, R-15/19.
  • Gasketed door(s) providing access to the mechanical room.
  • Supply and return ducts insulated to a minimum R-6.
  • Water pipes insulated to a minimum R-3.
  • Combustion air ducts insulated to R-8 or better where they pass through conditioned space.
  • Dryer exhaust shall not exceed 35′ in length, reduced by 2′-6″ for every 45-degree bend and 5′ for every 90-degree bend.
  • Dryers located in a closet require makeup air with an opening of at least 100 sq. in.
  • Exhaust ducts shall terminate outside the building per manufacturer instructions, or not less than 3′ in any direction from building openings if unspecified.
  • Exhaust duct terminations shall have a back-draft damper; screens shall not be installed at the termination.

Electrical Requirements

  • A workspace 30″ wide (or the width of the equipment, whichever is greater) and 36″ deep, floor to ceiling with a minimum height of 6′-6″, is required in front of panel boards.
  • Panel board workspace shall never be used for storage.
  • Panel boards shall not be located in clothes closets, bathrooms, toilet rooms, or over stairway steps.
  • A light must be provided for the panel board workspace, and the panel door must open to 90 degrees or more.
  • Use a 15 or 20 amp rated branch circuit for general lighting and receptacles.
  • A dedicated 20 amp circuit shall serve laundry room outlets only.
  • A dedicated 20 amp circuit shall serve bathroom receptacles, lighting, and exhaust fan, with no other outlets on that circuit.
  • Circuits serving habitable rooms, lighting, receptacles, and smoke detector outlets shall have arc-fault circuit breakers.

  • All 125-volt 15 & 20 amp receptacles shall be tamper-resistant.
  • No point along a floor/wall line shall be more than 6′ from a receptacle, with a maximum of 12′ between receptacles.
  • Any wall 2′ or longer requires a receptacle — this includes knee walls, built-in bars, and other fixed dividers.
  • Hallways longer than 10′ require at least one receptacle.
  • Receptacles for specific appliances shall be within 6′ of the appliance location.
  • Bathrooms require at least one GFCI-protected receptacle within 36″ of the sink rim edge and within 12″ of the basin top (arc-fault protection is not required in bathrooms).
  • Laundry appliances require at least one dedicated 20 amp, 12-wire receptacle with both AFCI and GFCI protection.
  • Every unfinished portion of the basement requires at least one GFCI-protected receptacle.
  • A receptacle is required within 25′ of heating and air-conditioning equipment for servicing.
  • At least one switch-controlled light is required in each room, hallway, and stairway (a switch-controlled receptacle may substitute in rooms other than bathrooms, kitchens, and hallways).
  • At least one switch-controlled or pull-chain light is required in each storage area and near heating/AC equipment.
  • Lighting fixtures shall not be installed within 3′ horizontally or 8′ vertically of a bathtub rim or shower threshold, unless marked “suitable for wet locations.”
  • Fixtures shall be installed so combustible materials aren’t exposed to temperatures above 90° F.

Permitted fixture types are limited to surface-mounted or recessed incandescent fixtures, LED luminaries with fully enclosed lamps, and surface-mounted or recessed fluorescent fixtures. Open or partially enclosed lamp fixtures and pendant fixtures or lamp holders are prohibited. Heating cables (floor heat) are also prohibited in closets.
